Greenmount LLC v. Cleanline Management, Nick Coburn | Litigation Update

On March 22, 2024, Greenmount filed a motion for preliminary injunction which requested a court order to prohibit any future marketing or selling of Flavorade on the basis that Cleanline and Coburn have purportedly used Greenmount’s trade secrets. The Court then held a hearing on June 27, 2024, in which it heard further evidence and argument from the parties and took the matter under submission for further consideration. 


On September 18, 2024, the Court issued a ruling completely in favor of Cleanline, Nick Coburn in which it denied Greenmount’s motion for preliminary injunction in full. In reviewing Greenmount’s request for a preliminary injunction, the Court was able to review all of the evidence submitted by all parties. (Court Order at 2, fn. 1.) Based on its review of the evidence and the arguments put forth by all parties, the Court found that, “based on the evidentiary record,” Greenmount “is unlikely to succeed on the merits” of all five of its claims. (Court Order at 16, 25, 27-28.) Specifically, in reaching its ruling, the Court credited the testimony and evidence provided by Cleanline and Coburn, and did not credit any of the testimony put forth by Greenmount. The Cleanline/Flavorade team continues to categorically deny all of Greenmount’s allegations. While the litigation is not over, we are confident, particularly in light of the Court’s recent ruling, that Flavorade will continue to be vindicated against the false allegations made by Greenmount. Flavorade has always been committed to ethical business practices and prioritized innovation, integrity, and fair competition within the cannabis industry. We have never done otherwise.
